Filmatic AI Affiliate Program Terms
and Conditions

1. Agreement Overview

These Terms and Conditions ("Agreement") govern the relationship between FilmaticAI, Inc. ("Company," "we," "us," or "our") and individuals or entities ("Affiliate," "you," or "your") who participate in the FilmaticAI Affiliate Program ("Program"). The Program is administered through PromoteKit ("Platform Provider"), a third-party affiliate management platform.

2. Eligibility

2.1. To participate in the Program, you must:

  • Be at least 18 years of age

  • Have a valid email address

  • Complete the affiliate registration process

  • Have a valid PayPal account for receiving commission payments

  • Comply with all applicable laws and regulations

2.2. The Company reserves the right to reject any application or terminate any affiliate relationship at its sole discretion.

3. Commission Structure

3.1. Affiliates will earn a commission on qualified sales generated through their unique affiliate links or codes.

3.2. Commission rates and structures will be communicated through the PromoteKit dashboard and may be modified by the Company with 30 days' notice.

3.3. Commissions are earned only on completed, paid transactions that are not subsequently refunded or charged back.

4. Tracking and Payment

4.1. Sales will be tracked through unique affiliate links or codes provided through the PromoteKit platform.

4.2. Commissions will be paid on a monthly basis for the previous month's earnings.

4.3. Payment will be made only when the accumulated commission reaches the minimum threshold of $100.

4.4. Payments will be made exclusively via PayPal. Affiliates must maintain a valid PayPal account to receive payments.

4.5. Payment Processing and Liability:

  • All payments are processed through PromoteKit

  • The Company is not responsible for any payment delays, errors, or issues arising from the PromoteKit platform

  • Any payment-related disputes must be addressed directly with PromoteKit

  • The Company's obligation is limited to ensuring proper tracking of commissions and communicating commission data to PromoteKit

5. Affiliate Obligations

5.1. Affiliates must:

  • Accurately represent the Company's products and services

  • Clearly disclose their affiliate relationship with FilmaticAI

  • Comply with all applicable disclosure requirements and regulations

  • Protect their affiliate links and codes from unauthorized use

5.2. Affiliates must not:

  • Engage in spam or unauthorized advertising

  • Make false or misleading claims about the Company or its products

  • Use the Company's trademarks or copyrighted materials without permission

  • Bid on the Company's branded terms in search engines

6. Prohibited Activities

6.1. The following activities are strictly prohibited:

  • Cookie stuffing or manipulation

  • Fraudulent clicks or transactions

  • Misrepresentation of the affiliate relationship

  • Use of the Company's intellectual property without permission

  • Creation of fake accounts or multiple accounts

7. Term and Termination

7.1. This Agreement remains in effect until terminated by either party.

7.2. Either party may terminate this Agreement at any time with written notice.

7.3. The Company may terminate this Agreement immediately for violations of these terms.

7.4. Upon termination, all affiliate links will be deactivated, and outstanding commissions will be paid according to the payment schedule.

8. Modifications

8.1. The Company reserves the right to modify these terms at any time.

8.2. Changes will be effective 30 days after notification to Affiliates.

9. Limitation of Liability

9.1. The Company is not liable for:

  • Technical issues affecting tracking or payment

  • Lost commissions due to blocked cookies or ad blockers

  • Indirect or consequential damages

  • Changes to the Program or commission structure

10. Confidentiality

10.1. Affiliates agree to maintain the confidentiality of any proprietary information shared by the Company.

11. Governing Law

11.1. This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States.
